These TC Cache Terms and Conditions (the “Terms”) are a legally binding agreement between you and Trading Card Cache LLC, doing business as TC Cache (“TC Cache,” “we,” “us,” or “our”). These Terms apply to your use of tccache.com, My Cache accounts, purchases, programs, services, content, and related features that are operated by or on behalf of TC Cache (collectively, the “Services”).
1. Agreement to These Terms
By creating a My Cache account after affirmatively accepting these Terms, placing an order after checkout conspicuously states that submitting the order constitutes agreement, enrolling in a TC Cache program that incorporates these Terms, or selecting a checkbox, button, or other electronic control that expressly indicates agreement, you agree to be bound by these Terms and any policies or program rules that are expressly incorporated into the applicable transaction or activity.
If you do not agree to these Terms, you should not create or use a My Cache account or complete a transaction or program enrollment that requires acceptance of them.
Electronic acceptance
Your electronic acceptance, including acceptance through a checkbox presented unchecked by default that you affirmatively select, or by activating an order or payment control that is immediately accompanied by conspicuous language stating that the action constitutes agreement, is intended to constitute your electronic signature and manifestation of assent to the fullest extent permitted by applicable law.
TC Cache may retain electronic records showing the version presented, the date and time of acceptance, the account or transaction associated with the acceptance, and the context in which acceptance occurred.
Defined TC Cache terminology
For clarity, My Cache is TC Cache’s customer account service, and a My Cache account is the customer account used to access that service.
TC Cache sometimes uses vault language as part of the My Cache visual theme. “Vault” does not identify a separate account, financial account, stored-value product, custodial service, or separate legal relationship. A Vault Password is simply the password credential used to authenticate a My Cache account.
Other branded or program-specific terms, including Build Program, Fully Loaded, Collector nickname, and Final Sale, are defined or explained in the sections that specifically govern those features.
Policies and program rules
These Terms may be supplemented by additional policies, disclosures, or rules that apply to particular Services or transactions, including the TC Cache Privacy Policy, Shipping Policy, Returns & Refunds Policy, Collector of the Month Official Rules, Fully Loaded terms and consumer disclosures, Build Program disclosures, product-specific notices, and other promotion-specific rules.
When a specific policy or set of Official Rules expressly governs a particular program or transaction, that more specific provision controls for that subject if it conflicts with a general provision of these Terms. The remainder of these Terms continues to apply.
Non-waivable rights
Nothing in these Terms is intended to waive, restrict, or eliminate any consumer protection, warranty, privacy, refund, dispute, or other right that applicable law does not permit TC Cache or a customer to waive by contract.
2. Eligibility and My Cache Accounts
You must be at least eighteen (18) years old and have reached the age of majority where you live to create, own, or control a My Cache account.
An eligible adult may purchase merchandise for, give merchandise to, or otherwise act on behalf of a minor where lawful, but the My Cache account must remain owned and controlled by the eligible adult. TC Cache does not require a minor to create an account in order for an adult customer to purchase merchandise intended for that minor.
Accurate account information
You agree to provide materially accurate, current, and complete information when creating or maintaining an account and to update information when reasonably necessary for account security, order fulfillment, legal compliance, or participation in an optional TC Cache program.
You may not use My Cache to impersonate another person, intentionally misrepresent your age or identity, use another person's email address without authorization, create an account through fraudulent means, or provide false information intended to defeat a TC Cache security, eligibility, purchase-limit, or fraud-prevention control.
One personal account per individual
Unless TC Cache expressly permits otherwise, each individual may maintain one personal My Cache account. Separate eligible adults who live in the same household may each maintain their own account.
Multiple accounts, related identities, alternate email addresses, household accounts, payment methods, or shipping addresses may not be used to circumvent:
- purchase or quantity limits;
- Collector of the Month standings or scoring rules;
- promotional limits or gift eligibility;
- account restrictions or suspensions;
- discount, credit, or benefit limits;
- security controls; or
- other TC Cache rules that reasonably apply on a per-person, per-household, per-account, or per-transaction basis.
TC Cache may require reasonable verification when information associated with an account creates a legitimate identity, security, fraud, eligibility, or program-integrity concern.
3. Ownership and Control of My Cache
My Cache is an account-based service operated by TC Cache. The My Cache platform, account infrastructure, account identifiers, authentication systems, software, interfaces, and related service features are owned, licensed, or controlled by Trading Card Cache LLC and its service providers.
Subject to these Terms, TC Cache grants you a personal, limited, revocable, non-exclusive, and non-transferable permission to access and use your My Cache account for its intended purposes.
The account is not transferable customer property
Unless TC Cache expressly permits a transfer or applicable law requires otherwise, a My Cache account may not be sold, purchased, rented, assigned, pledged, licensed to another person, transferred as part of another transaction, or otherwise commercially transferred. TC Cache may require additional verification before allowing another person to exercise control over an account.
TC Cache may modify, replace, retire, reclaim, suspend, or discontinue account identifiers, account functionality, or particular My Cache features when reasonably necessary for security, legal compliance, technical operation, fraud prevention, product development, or legitimate business reasons.
No My Cache feature, ranking, nickname, status, benefit, interface, or program is guaranteed to remain available indefinitely merely because it existed when an account was created.
4. Collector Nicknames
TC Cache may allow customers to select a Collector nickname for public or community-facing features, including Collector of the Month leaderboards and related displays.
A Collector nickname is a display identifier. It is not a legal name, does not replace the identity information associated with an order or account, and does not create an ownership right in the nickname or guarantee permanent use of it.
Nickname standards
Collector nicknames may not, as reasonably determined by TC Cache:
- impersonate another person, business, employee, administrator, or public figure;
- falsely imply employment by, endorsement from, or official association with TC Cache or another organization;
- contain unlawful, threatening, hateful, harassing, obscene, or materially abusive content;
- infringe or misappropriate another person's trademark, copyright, publicity, privacy, or other rights;
- publish private or sensitive personal information;
- contain misleading advertising, malicious links, or attempts to redirect customers away from TC Cache; or
- interfere with the integrity, readability, security, or intended operation of a TC Cache program.
TC Cache may reject, hide, remove, modify, or require replacement of a Collector nickname that violates these standards or creates a legitimate legal, security, impersonation, or program-integrity concern.
TC Cache may limit the frequency or number of nickname changes and may require customer support or account verification for additional changes. A nickname displayed publicly may remain visible in historical records, screenshots, archived program results, or other records even after a later nickname change where reasonably necessary to preserve accurate program history.
You should not use a Collector nickname to disclose information that you do not want displayed publicly.
5. Account Security and Authentication
You are responsible for taking reasonable steps to protect the credentials, email account, devices, and authentication methods used to access My Cache. You should use a unique Vault Password and should not intentionally share your Vault Password, verification codes, or authenticated session with another person.
Vault Passwords
TC Cache does not intend to store your Vault Password in readable form. Password authentication is designed to use one-way cryptographic processing so that TC Cache does not need to retrieve or email your existing password.
If you forget your Vault Password, TC Cache may require verification of the email address associated with the account before allowing a new password to be created.
Verification codes and new-browser checks
TC Cache may use temporary verification codes for purposes such as account creation, sign-in, password recovery, new-browser verification, or another security-sensitive action. Verification codes may expire, be limited to a particular purpose, be invalidated when replaced, and be rejected after repeated unsuccessful attempts.
TC Cache may also allow an eligible customer to remember a trusted browser or device for a limited period. Trusted-device status is a convenience feature, not a guarantee that additional verification will never be required.
No password-reset links by email
TC Cache will never ask you to send, reply with, or disclose your Vault Password, verification code, or complete financial information by email. Automated account and security messages may be sent from confirmation@tccache.com, but the appearance of an address alone does not prove that a message is genuine. When in doubt, open tccache.com directly rather than following a link contained in an unexpected message.
Protecting a compromised account
If TC Cache reasonably suspects account takeover, credential theft, fraudulent activity, or another security threat, TC Cache may require re-verification, revoke sessions, revoke trusted-device access, require a password change, temporarily restrict account functions, or take other proportionate security measures.
If you believe someone has gained unauthorized access to your My Cache account or the email account used to control it, you should secure the affected email account and contact TC Cache support as soon as reasonably possible.
TC Cache is not relieved of obligations imposed by applicable law merely because an account was accessed without authorization, and this section does not make a customer automatically responsible for every action performed by an unauthorized third party.
Back to top6. Account Restriction, Suspension, and Closure
TC Cache may refuse account registration or, to the fullest extent permitted by applicable law, restrict, suspend, deactivate, or terminate access to all or part of a My Cache account when TC Cache determines in good faith that action is reasonably appropriate to protect the business, its customers, its Services, or third parties.
Reasons account action may be taken
Account action may be taken for legitimate reasons including:
- suspected or confirmed fraud, payment abuse, chargeback abuse, account takeover, or unauthorized activity;
- material or repeated violation of these Terms, a program's Official Rules, or another applicable TC Cache policy;
- use of multiple accounts or other methods to evade purchase limits, promotional rules, account restrictions, security controls, or program eligibility requirements;
- threats, harassment, abusive conduct, or conduct that materially interferes with TC Cache operations or the lawful use of the Services by others;
- security threats, malicious automation, exploitation of software or pricing errors, attempted unauthorized access, or other conduct that threatens the integrity of the Services;
- a legal requirement, court order, government request, sanctions concern, or other compliance obligation;
- materially false account information or inability to complete reasonable verification when verification is legitimately required;
- operational, technical, risk-management, or business circumstances that make continued account access impracticable or inappropriate; or
- another good-faith reason reasonably related to safety, security, fraud prevention, legal compliance, program integrity, or operation of the TC Cache business.
Notice and scope of restrictions
Where appropriate, TC Cache may limit only the affected feature or program rather than closing an entire account. Depending on the circumstances, restrictions may apply to purchasing, promotional eligibility, Collector participation, nickname display, account access, or another feature.
TC Cache may act without advance notice when advance notice would reasonably create a security, fraud, legal, evidence-preservation, or operational risk, or when applicable law does not require prior notice. When appropriate and practicable, TC Cache may provide notice or information about the restriction and any available next steps.
Existing transactions and customer property
Restriction, suspension, or closure of a My Cache account does not by itself authorize TC Cache to retain customer funds, merchandise, refunds, or other property that the customer is legally entitled to receive.
An account restriction also does not automatically cancel an otherwise valid accepted order. An order may still be completed, cancelled, refunded, or otherwise handled according to the provisions governing that transaction, including inventory, fraud, payment, shipping, legal, or material-error considerations.
Customer-requested closure
You may request closure of your My Cache account through the methods TC Cache makes available. Account closure may end access to account-only features, but it does not erase transaction records, security records, legal acceptances, tax records, fraud-prevention information, or other records that TC Cache is required or reasonably permitted to retain.
Obligations and provisions that by their nature should continue after account closure, including provisions concerning completed transactions, intellectual property, fraud, payment disputes, legal records, and dispute resolution, may survive account closure.
Back to top7. Products and Listings
TC Cache sells trading cards, sealed trading-card products, collectibles, toys, and other merchandise. TC Cache makes reasonable efforts to present product information accurately and in a manner that allows customers to understand what they are purchasing.
Listing information
A listing may include information such as:
- title and product type;
- actual-item, reference, stock, catalog, or manufacturer photographs;
- condition;
- edition, set, rarity, finish, variation, language, or region;
- quantity or inventory status;
- manufacturer or publisher information;
- release information or product configuration;
- included accessories or components; and
- other details reasonably relevant to the merchandise.
Actual-item and reference images
When a listing expressly indicates that photographs show the actual item, those photographs are intended to depict the specific copy or unit offered for sale, subject to ordinary differences in screen display, lighting, image compression, and photography.
When a listing uses a reference, stock, catalog, or manufacturer image, the image is intended to identify or illustrate the product type and does not represent that the customer will receive the exact physical unit shown in the image. The received item may have ordinary factory, packaging, print, or production variation consistent with the product sold.
Third-party and catalog information
Some product information may originate from manufacturers, publishers, distributors, catalog providers, price-data providers, or other third parties. TC Cache may reasonably rely on that information but does not control every third-party database or source. If TC Cache discovers that material listing information is inaccurate, TC Cache may correct the listing and handle any affected transaction under these Terms and applicable law.
Availability
Displaying merchandise on the website does not guarantee that the merchandise remains available. Low-quantity collectibles may be purchased by another customer, removed from sale, deactivated, reserved for an already-completed transaction, or become unavailable because of an inventory discrepancy before a new transaction is accepted.
8. Pricing of Unsold Merchandise
Unless prohibited by applicable law, TC Cache may increase or decrease the price of any merchandise that has not yet been sold in an accepted transaction. Prices may change at any time before an order is accepted.
Retail pricing is independently determined
TC Cache may determine or adjust retail prices based on legitimate business and market factors including:
- condition and presentation of the specific item;
- inventory and availability;
- supply and demand;
- acquisition cost;
- market activity and comparable transactions;
- actual-item photography or other listing-specific presentation;
- rarity, language, finish, edition, region, or variation;
- promotional pricing or discounts;
- operational cost; and
- other ordinary retail considerations.
Third-party marketplace prices, price guides, market estimates, recent sales, or suggested retail prices may be useful reference points but do not establish a mandatory selling price for TC Cache merchandise.
Earlier prices do not create an entitlement
A customer does not acquire a right to an earlier price merely because that price was previously displayed, advertised, viewed, saved, bookmarked, screenshotted, or placed in a shopping cart. A price remains subject to change until the applicable transaction is accepted.
TC Cache may also begin, modify, or end a discount or promotion for future transactions at any time, subject to applicable law and the specific terms of that promotion.
Taxes and transaction charges
Applicable taxes, shipping charges, and other lawful transaction-specific amounts will be disclosed as required before the customer submits the order. Nothing in this section authorizes hidden mandatory fees or deceptive price presentation.
Back to top9. Shopping Carts and Inventory
The TC Cache shopping cart is a convenience feature. Adding merchandise to a cart does not reserve inventory, create an order, guarantee a price, create a contract, or obligate TC Cache to sell the merchandise.
No inventory reservation
Unless TC Cache expressly states otherwise for a specific feature, merchandise in a cart remains available for purchase by other customers until a transaction for that inventory is successfully completed and accepted. This is particularly important for one-of-one, low-quantity, and fast-moving collectible inventory.
Cart prices and availability may refresh
Before checkout is completed, TC Cache may refresh or revalidate:
- current price;
- available quantity;
- variation or finish;
- promotional eligibility;
- shipping eligibility;
- purchase limits; or
- other transaction information.
If a cart contains stale information, the website may update the cart, prevent checkout of unavailable merchandise, request that the customer review a changed price or quantity, or remove an item that is no longer available.
Saved carts and browser storage
TC Cache may use cookies, local browser storage, account features, or other technical methods to preserve cart contents for convenience. Cart persistence is not guaranteed. Clearing browser data, changing devices, account changes, software updates, inventory changes, or technical failures may alter or remove saved cart information.
The existence of a saved cart does not extend a promotion, preserve promotional eligibility, reserve inventory, or freeze a prior price.
Back to top10. Market Movement After an Accepted Sale
Trading cards and other collectibles can increase or decrease in market value quickly. Once TC Cache has accepted a valid transaction, later movement in the item's secondary-market value does not by itself change the agreed purchase price.
If the market price increases
TC Cache will not cancel an otherwise valid accepted transaction solely because the merchandise later increased in value, a new comparable sale occurred, market demand increased, or TC Cache later believes that the item could have been sold for a higher price.
If the market price decreases
A customer is likewise not entitled to a retroactive price reduction, credit, refund, or price adjustment solely because the merchandise later decreased in value, became available elsewhere for less, or a market guide or comparable sale changed after the transaction was accepted.
Other valid transaction rules still apply
This section does not prevent cancellation, correction, refund, or another remedy for a reason separately permitted by these Terms or required by law, including a genuine material pricing or listing error, fraud, payment failure, inventory failure, legal restriction, qualifying return, or material misrepresentation.
A market-price change by itself is not a product defect, listing error, or guarantee of a future return or resale value.
11. Pricing, Listing, Inventory, and Technical Errors
TC Cache makes reasonable efforts to keep prices, listings, inventory, promotions, and transaction information accurate. Collectible inventory is often low quantity and may depend on manual entry, catalog data, integrations, cached information, or other systems. Genuine errors can occasionally occur.
Material and obvious errors
TC Cache may correct a genuine material or obvious error, including:
- a misplaced decimal, omitted digit, transposed number, or other clear data-entry error;
- a materially incorrect product, variation, finish, language, quantity, or condition attached to a listing;
- duplicate or nonexistent inventory;
- a corrupted, stale, or failed catalog, import, cache, or integration value;
- a discount, promotion, shipping amount, or tax calculation that was displayed or applied because of a material technical malfunction;
- a price or product configuration that a reasonable person would recognize as materially inconsistent with the listing or surrounding transaction information; or
- another genuine technical, inventory, or listing mistake of comparable significance.
A material error is different from ordinary market movement, a change in TC Cache's business judgment, or seller's remorse. TC Cache may not use this section merely because an accurately listed collectible became more valuable after a valid sale.
How an affected order may be handled
If TC Cache discovers a material error before an affected order is fulfilled, TC Cache may correct the information, refuse or cancel the affected item or order, or offer the customer the opportunity to purchase at the corrected terms where appropriate.
TC Cache will not silently increase the amount charged to a customer because a displayed price was wrong. If proceeding would require a higher purchase price or another material change, the customer must affirmatively agree to the corrected transaction or the affected item will be cancelled and any captured payment for it refunded.
If an error caused a customer to be charged more than the correct amount and the transaction otherwise proceeds, TC Cache will correct or refund the excess amount as appropriate.
Payment and fulfillment status
An authorization, payment capture, automated receipt, or order acknowledgment does not prevent TC Cache from correcting a genuine material error before fulfillment under this section. If TC Cache cancels merchandise after payment has been captured, TC Cache will issue the applicable refund to the original payment method or another lawful method where necessary.
If merchandise has already been shipped or delivered before an error is discovered, the parties' rights and remedies will depend on the circumstances and applicable law. This section does not authorize TC Cache to make an additional charge without consent, repossess delivered merchandise without legal authority, or avoid a non-waivable consumer right.
12. Order Submission and Acceptance
When you submit an order, you are offering to purchase the identified merchandise on the terms presented at checkout. Your act of placing the order may also constitute acceptance of these Terms and the transaction policies conspicuously presented with the order, even though TC Cache has not yet accepted the merchandise purchase itself.
Order acknowledgments
An automated confirmation, payment-provider message, order number, authorization, or receipt generally confirms that the order was received or that payment processing occurred. It does not necessarily mean that TC Cache has completed inventory, fraud, payment, address, purchase-limit, material-error, or other reasonable order validation.
When TC Cache accepts an order
Unless TC Cache expressly states otherwise, an order or affected portion of an order is accepted when TC Cache sends a communication expressly confirming acceptance or fulfillment, tenders the merchandise to the carrier, or begins irreversible custom assembly or fulfillment after completing the applicable validation steps.
For customer-directed Build Program merchandise, acceptance may occur when TC Cache begins custom assembly after the order has passed applicable validation. The separate Build Program terms may provide additional rules concerning when customization begins and when voluntary cancellation is no longer available.
Orders containing multiple items
TC Cache may accept, refuse, cancel, or refund individual items within a multi-item order when circumstances affecting one item do not reasonably require cancellation of the entire order. If an order is split or partially cancelled, TC Cache will adjust or refund affected amounts as appropriate.
No unapproved material substitutions
TC Cache will not knowingly replace purchased merchandise with materially different merchandise without the customer's agreement merely because the ordered item became unavailable. Promotional gifts and programs may have separate disclosed substitution rules that apply only to the promotional item and not to the merchandise the customer purchased.
Back to top13. Customer Cancellation Requests
If you wish to cancel an order, contact TC Cache as soon as reasonably possible using the support method provided on tccache.com. A cancellation request is not effective until TC Cache confirms that the affected order or item was successfully cancelled.
Before shipment or fulfillment
TC Cache will make reasonable efforts to honor a cancellation request received before shipment or before fulfillment has materially begun, but cancellation is not guaranteed. Orders may move into packing, label creation, carrier handoff, or other fulfillment stages quickly.
Custom and Build Program merchandise
Customer-directed Build Program products and other customized or assembled-to-order merchandise may become non-cancellable once custom assembly has begun. The applicable product page, Build Program terms, or Returns & Refunds Policy may provide additional notice concerning Final Sale or customization status.
After shipment
Once an order has shipped, a voluntary cancellation generally cannot be completed through the order system. Any return or refund request is then governed by the Returns & Refunds Policy and applicable law. Refusing delivery does not automatically create a right to a refund or eliminate return-shipping or returned-to-sender rules that otherwise lawfully apply.
Refund after successful cancellation
If TC Cache confirms a cancellation after payment has been captured, TC Cache will refund the applicable cancelled amount. The time required for the payment provider or financial institution to post the refund is outside TC Cache's direct control.
A customer does not obtain an additional cancellation right merely because a collectible's market value decreased after the order was placed or accepted. Nothing in this section limits cancellation or refund rights required by shipping-delay law, consumer-protection law, or another non-waivable rule.
Back to top14. Cancellation or Refusal by TC Cache
TC Cache may refuse, reduce, or cancel an order or affected item when a legitimate transaction, legal, security, inventory, or operational issue prevents or makes fulfillment inappropriate.
Examples of legitimate cancellation reasons
Reasons may include:
- insufficient, duplicate, damaged, or unavailable inventory;
- a genuine material pricing, listing, catalog, or technical error described in Section 11;
- payment failure, payment reversal, unauthorized payment, or a credible fraud concern;
- an address or delivery issue that cannot reasonably be resolved before fulfillment;
- violation or attempted circumvention of an applicable purchase limit;
- a legal restriction, sanctions issue, government requirement, product recall, or safety concern;
- an order that cannot lawfully or reliably be shipped to the stated destination;
- material misuse of a promotion, account, coupon, credit, or other benefit;
- a material systems failure that prevents reliable fulfillment; or
- another good-faith circumstance of comparable significance that makes the transaction unlawful, fraudulent, impossible, or materially unsafe to fulfill.
No cancellation solely because value increased
TC Cache will not cancel an otherwise valid accepted sale solely because the merchandise later increased in market value, a higher comparable sale appeared, or TC Cache later wishes it had charged more. Section 10 governs ordinary post-sale market movement.
Partial cancellation
When only part of an order is affected, TC Cache may cancel the affected item while fulfilling the remainder if doing so is reasonable and does not materially alter the customer's agreed transaction without disclosure.
Refunds for cancelled merchandise
If TC Cache cancels merchandise after collecting payment, TC Cache will refund the amount properly attributable to the cancelled merchandise, together with any other amount that applicable law requires to be refunded. TC Cache will not substitute store credit for a monetary refund where applicable law requires return of the customer's money.
Promotional eligibility, Collector points, discounts, gifts, or other benefits dependent on a cancelled or reversed transaction may also be cancelled or adjusted according to the applicable program rules.
Back to top15. Purchase Limits and Anti-Circumvention
TC Cache may establish reasonable purchase or quantity limits to promote fair access to limited inventory, reduce fraud, comply with supplier or legal restrictions, protect promotions, or manage high-demand merchandise.
How limits may apply
Depending on the product or program, a limit may apply by:
- individual;
- My Cache account;
- household;
- shipping or billing address;
- payment method or payment account;
- order or transaction;
- product, variation, release, or promotional period;
- time period; or
- another reasonable criterion disclosed or applied in good faith.
Separate eligible adults in the same household may maintain separate My Cache accounts as described in Section 2. A household-based purchase limit, when one applies, may nevertheless limit the combined quantity that can be purchased for the same household or destination.
No circumvention
You may not intentionally evade a purchase limit through multiple accounts, alternate identities, coordinated orders, alternate payment methods, repeated addresses, automated purchasing tools, intermediaries, or other methods designed primarily to defeat the stated limit.
TC Cache may review related transaction information reasonably necessary to enforce a legitimate limit and may reduce quantities, cancel excess orders, restrict promotional eligibility, or take proportionate account action when there is a good-faith basis to conclude that circumvention occurred.
Changes to future limits
TC Cache may introduce, change, or remove purchase limits for future transactions based on inventory, demand, security, supplier requirements, or other legitimate business considerations. A purchase limit does not reserve inventory or guarantee that the permitted quantity will remain available.
Purchase limits will not be applied for a purpose prohibited by applicable anti-discrimination or consumer-protection law, and nothing in this section authorizes TC Cache to retain payment for merchandise that TC Cache cancels because a limit was exceeded.
16. Payments, Taxes, and Payment Disputes
TC Cache may use third-party payment processors and financial-service providers to authorize, process, capture, refund, or otherwise administer payments. Payment methods displayed at checkout may change over time and may be subject to the separate terms, eligibility requirements, security controls, and availability of the applicable provider.
Payment authorization and capture
Submitting payment information or receiving a payment authorization does not by itself guarantee that an order has been accepted. Payment activity may occur before TC Cache completes the order-validation steps described in Section 12. If TC Cache cancels paid merchandise, TC Cache will issue the applicable refund as required by these Terms and applicable law.
You represent that you are authorized to use the payment method submitted with the transaction. You may not knowingly use stolen, unauthorized, fraudulent, or improperly obtained payment credentials.
Payment information
TC Cache does not intend to store complete payment-card numbers, card security codes, or payment-provider passwords. Third-party payment providers may process that information directly and may provide TC Cache with limited transaction identifiers, status information, payer details, or other information reasonably necessary to complete the transaction, issue refunds, prevent fraud, maintain records, or respond to disputes.
Taxes and government charges
TC Cache may calculate, collect, report, and remit sales, use, or other transaction taxes when required by applicable law. The amount and taxability of a transaction can depend on the merchandise, destination, applicable law, and information available at checkout.
If a material tax-calculation error is discovered before an order is accepted, TC Cache may correct the transaction under Section 11. TC Cache will not silently impose a new discretionary charge after checkout. Nothing in these Terms prevents collection or adjustment of an amount that applicable law expressly requires, but TC Cache will provide appropriate notice where required.
Where applicable law places a use-tax or similar obligation directly on the purchaser for a transaction on which TC Cache did not collect the tax, the purchaser remains responsible for that legal obligation.
Chargebacks and payment disputes
Customers retain all legitimate rights to dispute unauthorized, erroneous, or otherwise legally disputable transactions with their payment provider. TC Cache may encourage a customer to contact support first when practical so that an issue can be investigated quickly, but nothing in these Terms requires a customer to surrender a non-waivable payment-dispute right.
TC Cache may provide relevant transaction, account, communication, fulfillment, tracking, acceptance, and return records to a payment provider or financial institution when responding to a dispute.
Knowingly false payment disputes, fabricated non-receipt claims, return substitution, use of unauthorized payment credentials, repeated attempts to obtain both a merchant refund and a payment-provider recovery for the same amount, or other intentional payment abuse may result in order cancellation, account restriction, loss of promotional eligibility, preservation of evidence, or other lawful remedies.
While a chargeback or payment dispute concerning the same transaction is pending, TC Cache may pause a duplicative merchant-side refund until the payment provider resolves or closes the dispute, to the extent permitted by law. TC Cache will not intentionally retain a double recovery to which it is not entitled.
17. Shipping and Delivery
Physical orders are subject to the TC Cache Shipping Policy and to the shipping method, destination, and other delivery information presented for the applicable transaction. This section establishes the general shipping terms while the Shipping Policy provides the more detailed operational rules.
Processing time and transit time
A processing or shipment estimate refers to the period in which TC Cache expects to prepare the merchandise and tender it to the applicable carrier unless the site expressly states otherwise. Carrier transit time begins after carrier handoff and is separate from TC Cache processing time.
TC Cache will maintain a reasonable basis for shipment representations and will comply with applicable requirements concerning delayed shipment, customer consent, cancellation, and refunds. If no shipment period is stated, applicable federal law generally requires online sellers to have a reasonable basis to expect shipment within 30 days of a properly completed order.
Shipping methods and tracking
Available methods may include Economy letter-mail services, USPS Ground Advantage, Priority Mail, Express or expedited services, or other methods displayed at checkout. Availability may depend on product type, quantity, value, weight, thickness, dimensions, destination, carrier rules, and other legitimate fulfillment considerations.
Tracking capabilities vary by method. Economy letter-mail services may rely on automated processing scans and may provide substantially fewer tracking events than package services. A tracking identifier does not guarantee continuous point-to-point scanning, a carrier acceptance scan, or a doorstep delivery scan.
Delivery estimates
Unless a service is expressly identified as carrying a guaranteed carrier commitment, delivery dates and transit estimates are estimates rather than guarantees. Weather, holidays, carrier congestion, transportation failures, local delivery conditions, labor interruptions, government action, and other events outside TC Cache's reasonable control may affect delivery.
Shipping addresses
You are responsible for reviewing the recipient name, street address, apartment or unit number, city, state, postal code, and other material delivery information before placing an order. TC Cache may use address-validation services, but validation does not guarantee successful delivery.
Contact TC Cache promptly if you discover an address error. TC Cache cannot guarantee that an address can be changed after submission and may decline a material reroute for fraud-prevention or payment-security reasons. When an unsafe or unreliable address change cannot be completed, cancellation and refund may be used where appropriate.
Shipping charges
Shipping charges shown at checkout may reflect reasonable postage, carrier, packaging, insurance, and shipping-related fulfillment costs as permitted by law. TC Cache will not intentionally characterize a mandatory non-shipping fee as a shipping charge where applicable law requires that fee to be included in the advertised merchandise price.
Carrier delays, missing shipments, and delivery scans
After a shipment is tendered to a carrier, carrier delays are distinct from a delay by TC Cache in shipping the order. TC Cache may assist with tracking review, carrier inquiries, missing-mail procedures, insurance claims, or other reasonable investigation when a shipment appears delayed, damaged, or missing.
A carrier status marked "Delivered" is relevant evidence but does not automatically prevent review of a credible delivery problem. The available remedy will depend on the shipping method, evidence, circumstances, applicable carrier process, and law.
Returned-to-sender shipments
If an order is returned because of a materially incorrect customer-provided address, refusal of delivery, failure to retrieve a shipment, or another customer-caused delivery problem, TC Cache may require payment of reasonable reshipping costs before sending the merchandise again. Where a refund is appropriate, non-refundable shipping expenses actually incurred may be deducted to the extent permitted by law. This does not apply when the return resulted from TC Cache's own fulfillment or addressing error.
Risk of loss and mandatory rights
Nothing in these Terms is intended to transfer risk of loss earlier than applicable law permits or to eliminate a mandatory remedy for merchandise that is not delivered. The parties' legal rights concerning loss in transit remain subject to applicable law.
Back to top18. Returns and Refunds
Returns, exchanges, and refunds are governed by the TC Cache Returns & Refunds Policy, product-specific Final Sale notices, and applicable law. This section summarizes the general framework that the separate policy will address in greater detail.
General return window for eligible merchandise
Unless merchandise is identified as Final Sale or another product-specific rule applies, TC Cache provides a 14-calendar-day return period after documented delivery for eligible merchandise. A qualifying return must involve the same item purchased from TC Cache and must remain in materially the same condition in which it was delivered, subject to the more detailed requirements in the Returns & Refunds Policy.
Original packaging, accessories, certificates, holders, or other included components may be required where reasonably relevant to the value, identity, condition, or resale of the merchandise.
Wrong item, material misdescription, damage, and authenticity concerns
Final Sale status does not authorize TC Cache to knowingly send the wrong product, materially misdescribe merchandise, sell counterfeit merchandise, or disregard a mandatory remedy for qualifying shipping damage or another legally protected issue. Customers should contact TC Cache promptly when they believe one of these problems occurred.
For visible shipping damage, obvious fulfillment errors, or missing contents, TC Cache may recommend notice within 48 hours to improve the quality of available evidence and carrier options. That recommendation is not an automatic forfeiture deadline where applicable law or the circumstances provide additional time.
Return authorization and inspection
Customers should obtain return instructions before sending merchandise back. TC Cache may inspect returned merchandise and may compare photographs, identifying characteristics, certification numbers, serial numbers, condition details, packaging, fulfillment records, or other reasonable evidence.
TC Cache may deny or adjust a discretionary return to the extent permitted by law if the merchandise is not the original item, has been substituted, altered, opened contrary to a disclosed Final Sale condition, materially damaged after delivery, stripped of required components, resealed, or otherwise fails to satisfy the applicable return requirements.
Return shipping
When a return is required because TC Cache sent the wrong item, materially misdescribed the merchandise, or is responsible for another qualifying error, TC Cache will generally provide or reimburse reasonable return shipping as appropriate. For a permitted change-of-mind return that is not caused by TC Cache, the customer is generally responsible for return shipping unless TC Cache states otherwise.
Refund amount and method
Approved refunds are generally based on the amount actually paid for the affected merchandise after applicable discounts, credits, and adjustments. A refund is not recalculated using the item's current market value, a later TC Cache price, or a later third-party sale.
Refunds will generally be returned to the original payment method. Another lawful method may be used if the original method cannot receive the refund, the payment provider requires another process, applicable law requires it, or the customer and TC Cache expressly agree.
TC Cache will not substitute store credit where applicable law requires a monetary refund.
Promotions, points, gifts, and reversed transactions
If a transaction is cancelled, refunded, reversed, charged back, or determined fraudulent, TC Cache may reverse associated Collector points, purchase-based promotional eligibility, discounts, or other benefits to the extent permitted by the applicable program rules and law. If a promotional item must be returned as part of a qualifying purchase reversal, that requirement must be supported by the applicable promotion terms and applicable law.
No waiver of mandatory rights
Nothing in the Returns & Refunds Policy or these Terms eliminates a warranty, defective-product remedy, statutory refund right, or other consumer protection that applicable law does not permit TC Cache to waive.
19. Sealed Trading Card Products
Because opened or disturbed trading-card products can be difficult or impossible to verify as originally sealed and unsearched, TC Cache designates sealed trading-card merchandise containing unopened packs as Final Sale to the fullest extent permitted by applicable law, unless a listing expressly states otherwise.
Products covered
This may include:
- booster packs and sleeved booster packs;
- booster boxes and display boxes;
- Elite Trainer Boxes and similar trainer or collection boxes;
- tins, blisters, bundles, collection products, and special sets;
- Build & Battle products, prerelease products, or decks that include randomized unopened packs; and
- other sealed trading-card merchandise containing unopened randomized packs.
Customer-directed TC Cache Build Program products are separately governed by the Build Program provisions and applicable Build disclosures, even when TC Cache seals the completed Build product.
Conspicuous Final Sale notice
Where TC Cache applies Final Sale status, the restriction should be clearly disclosed on the applicable product page, listing, cart or checkout presentation, or another conspicuous pre-purchase location. TC Cache will not rely solely on a hidden legal-policy page where applicable law requires a clearer pre-sale disclosure.
Opening or disturbing sealed merchandise
Once factory or TC Cache packaging for a Final Sale product has been opened, cut, torn, broken, unsealed, materially disturbed, or otherwise altered after delivery, TC Cache generally cannot accept a voluntary return based on change of mind. This rule protects against pack searching, weighing, mapping, substitution, resealing, product swapping, and similar problems that cannot reliably be ruled out after opening.
What "sealed" means
A product described as "sealed" means the applicable factory seals or unopened packaging remain intact unless the listing expressly discloses otherwise. Sealed does not mean cosmetically flawless or display grade. Outer boxes, shrink wrap, cardboard, tins, or other packaging can have ordinary manufacturing, shipping, shelf, or handling wear without the underlying product having been opened.
TC Cache will make reasonable efforts to disclose known material packaging damage when it would reasonably matter to the purchase. Minor cosmetic packaging variation that does not compromise the sealed status is not automatically a product defect or material misdescription.
Exceptions and non-waivable rights
Final Sale treatment does not eliminate remedies that apply because TC Cache sent the wrong item, materially misdescribed the merchandise, sold counterfeit merchandise, failed to disclose a materially compromised seal, caused or is responsible for qualifying damage, or because applicable law otherwise requires a remedy.
If a customer believes factory sealing was materially compromised before delivery, the customer should preserve the product and packaging and contact TC Cache before opening or further altering it whenever reasonably possible.
20. Imported and Regional Products
TC Cache may sell trading cards, sealed products, toys, or collectibles that were manufactured, packaged, published, or originally distributed for a market outside the United States or for a particular language or region.
Regional differences
Imported or regional merchandise may differ from a U.S.-market version in ways including:
- language;
- card numbering, set composition, rarity structure, or product configuration;
- packaging, labels, inserts, or promotional materials;
- included code cards, digital content, or region-specific redemption;
- release dates or manufacturer naming conventions;
- manufacturer support or warranty coverage;
- regulatory marks or package information; and
- other characteristics specific to the intended market.
Language and region disclosures
TC Cache will make reasonable efforts to identify the product language or region when that information is material to the purchase. Customers are responsible for reviewing those disclosed details before ordering.
A product is not defective merely because an authentic regional version differs from a U.S. version in a manner consistent with the disclosed language or market. If the merchandise received is materially different from the language, region, edition, or product configuration that TC Cache actually represented, the Returns & Refunds Policy may provide an appropriate remedy.
Codes, digital features, and manufacturer support
TC Cache does not guarantee that a region-specific code, digital redemption, application feature, online service, manufacturer promotion, or warranty intended for another market will function or be honored in the United States unless the listing expressly guarantees that compatibility or support.
Third-party manufacturers and publishers control their own redemption systems, online services, warranty programs, and regional restrictions, and those systems may change independently of TC Cache.
No implied manufacturer affiliation
The sale of third-party merchandise does not mean that TC Cache is sponsored, authorized, endorsed, or otherwise affiliated with the manufacturer, publisher, licensor, league, or rights holder unless TC Cache expressly states that such a relationship exists.
21. Collectible Condition
Collectible condition can materially affect desirability and market value, but condition assessment is not perfectly objective. TC Cache makes reasonable efforts to describe the observable condition of merchandise accurately using the listing information, photographs, condition labels, and product-specific disclosures available at the time of sale.
Condition involves reasonable judgment
Two reasonable collectors, sellers, buyers, or grading professionals may evaluate the same item differently. Unless TC Cache expressly guarantees a particular objective characteristic, a minor difference of opinion concerning condition does not by itself establish that merchandise was materially misdescribed.
Condition considerations may include:
- corners, edges, surface, and centering;
- scratches, print lines, whitening, dents, bends, creases, or indentations;
- factory cutting, print quality, registration, or ink characteristics;
- foil or finish appearance;
- packaging wear, shelf wear, or storage wear;
- age-related characteristics; and
- other observable characteristics reasonably relevant to the type of collectible.
Photographs and disclosed characteristics
When TC Cache provides photographs of the actual item, customers should review those photographs together with the written condition description before purchase. Photographs may reveal ordinary characteristics that are difficult to describe exhaustively in text, subject to reasonable differences in lighting, screen color, image compression, focus, and viewing device.
A characteristic that is clearly visible in an actual-item photograph and not inconsistent with an express written representation may be considered part of the product information presented before purchase.
Material differences remain covered
Condition subjectivity does not permit TC Cache to materially misrepresent merchandise. If an item is materially different from the listing as a whole, the customer may have a remedy under the Returns & Refunds Policy or applicable law.
Customers should contact TC Cache promptly if they believe merchandise arrived in materially different condition from the condition presented in the listing, and should preserve the merchandise and packaging while the issue is reviewed.
22. Third-Party Grading
Unless merchandise is expressly sold as already graded or authenticated by a named third-party service, TC Cache does not guarantee that a raw card, collectible, autograph, or other item will receive any particular grade, designation, authentication result, population status, or certification outcome from a third-party grading or authentication company.
Raw merchandise
Terms such as “Near Mint,” “Lightly Played,” “Excellent,” or other condition descriptions used for raw merchandise are retail condition descriptions and are not promises that the item will receive a corresponding numerical grade or designation from PSA, CGC, Beckett, SGC, or another grading company.
TC Cache does not represent that a raw item is “gradeable,” “gem mint,” a guaranteed 10, or otherwise certain to satisfy a grading company's standards unless an express written guarantee specifically states otherwise.
Independent third-party standards
Grading and authentication companies establish and apply their own standards, procedures, technology, fees, turnaround times, population reporting, labels, and policies. Those standards can change and are outside TC Cache's control.
A third-party company may:
- assign a different grade than a customer expected;
- decline to grade or authenticate an item;
- identify an alteration, restoration, trimming, recoloring, cleaning, or other characteristic;
- change a designation or certification policy;
- make an error; or
- reach a different conclusion from another grading company.
Items sold already graded
If TC Cache sells an item in a third-party holder, the listing should identify the grading company and certification information where reasonably applicable. TC Cache does not control the grading company's continuing recognition of a certification, future population changes, future market value, or the grading company's subsequent policies.
If TC Cache expressly represents that a graded item is authentic or carries a particular certification and the merchandise received is materially inconsistent with that representation, the applicable Returns & Refunds Policy and non-waivable legal rights remain available.
No reimbursement for speculative grading outcomes
Unless TC Cache expressly agreed in writing to a grading-related guarantee, TC Cache is not responsible for grading fees, shipping to or from a grading company, lost anticipated grade premiums, lost resale opportunities, or differences between a customer's expected grade and a third party's actual result solely because the third party reached a different condition or authentication conclusion.
23. Factory and Manufacturing Variation
Trading cards, toys, sealed products, packaging, and other collectibles are manufactured by third parties and can contain ordinary production variation. TC Cache does not manufacture the underlying third-party merchandise and cannot control every factory characteristic.
Examples of manufacturing variation
Depending on the product, ordinary factory or manufacturing characteristics may include:
- off-centering, print lines, print dots, ink variation, registration variation, or cutting variation;
- minor scratches, surface marks, edge characteristics, corner characteristics, roller marks, or foil variation;
- crimping, pack-seal placement, wrapper variation, shrink-wrap variation, or excess wrap;
- small dents, folds, scuffs, glue marks, cardboard wear, or packaging compression;
- figure paint variation, molding variation, assembly variation, or packaging alignment;
- differences between production runs, factories, regions, or release waves; and
- other characteristics arising during legitimate manufacture, packaging, distribution, or factory handling.
Factory variation is not automatically a TC Cache error
The presence of a manufacturing characteristic does not by itself mean that TC Cache damaged, altered, opened, or materially misdescribed the merchandise. Whether a particular characteristic is material depends on the product, the listing, what TC Cache knew or reasonably should have disclosed, and applicable law.
TC Cache will make reasonable efforts to disclose known material defects or damage when they would reasonably affect a purchasing decision. Ordinary manufacturing variation that is consistent with genuine merchandise and not contrary to an express listing representation is not automatically a defect attributable to TC Cache.
Manufacturer remedies
Some manufacturers may offer replacement, warranty, or quality-control programs for factory defects. Any manufacturer remedy is controlled by the manufacturer and may depend on region, product, proof of purchase, timing, inventory, or other requirements. TC Cache does not guarantee that a manufacturer will provide a replacement or other remedy unless TC Cache expressly makes that guarantee.
Non-waivable rights preserved
Nothing in this section eliminates a warranty, defective-product remedy, recall right, or consumer protection that applicable law does not permit TC Cache to waive.
24. Randomized Manufacturer Products
Many manufacturer-produced trading-card and collectible products contain randomized, assorted, blind, or otherwise variable contents. Unless TC Cache expressly states otherwise, TC Cache does not control the manufacturer-determined contents of an unopened randomized product.
No guaranteed pull or content
Unless a listing expressly guarantees a particular included item, purchasing a randomized manufacturer product does not guarantee:
- a specific card, character, player, variant, insert, parallel, rarity, or finish;
- a particular number of high-rarity or premium items;
- a particular pull rate or distribution within an individual box, pack, case, tin, or bundle;
- a particular market value;
- a particular grading outcome; or
- that the value of the contents will equal or exceed the retail price paid.
Published odds and manufacturer statements
If TC Cache references manufacturer-published pull rates, odds, insertion ratios, box averages, or similar information, that information is provided for identification or general informational purposes unless TC Cache expressly adopts it as its own guarantee. Manufacturer statements may describe averages over a production run and may not guarantee the contents of any individual unit.
Past openings, customer reports, social-media videos, prior boxes, prior cases, or prior pulls do not guarantee future results.
Random contents are different from TC Cache promotional programs
This section concerns randomized contents created, packaged, or determined by third-party manufacturers. TC Cache-operated promotional programs, including Fully Loaded, are governed by their own terms, disclosures, availability rules, and program-specific provisions.
Tampering and authenticity
TC Cache does not knowingly sell counterfeit or intentionally resealed manufacturer products as factory sealed. If a customer has a credible concern that a product was materially tampered with before delivery, the customer should preserve the product, wrapper, seals, shipping materials, and other relevant evidence and contact TC Cache promptly before further opening or alteration when reasonably possible.
25. Market Values and Price Information
Collectibles can change in price rapidly and sometimes significantly. Any market, sales-history, comparable-sale, price-guide, estimated-value, or similar information displayed or referenced by TC Cache is provided for general informational and retail-context purposes unless an express written statement says otherwise.
No guaranteed market value
TC Cache does not guarantee that a collectible can be sold, traded, graded, insured, or replaced at any stated or displayed amount. A price observed on one marketplace or at one point in time may differ from:
- another marketplace;
- another copy in a different condition;
- an actual completed sale;
- a current asking price;
- a dealer buy price;
- an auction result;
- an insured or replacement value; or
- the amount a future buyer is willing to pay.
Third-party market data
TC Cache may reference or use information from third-party marketplaces, price guides, sales databases, manufacturers, grading companies, or other sources. Third-party market data can be incomplete, delayed, erroneous, manipulated, based on different conditions or variants, or change after it is displayed. TC Cache may correct or update market-related information when appropriate.
Third-party price information does not establish a mandatory purchase or resale price for TC Cache merchandise. TC Cache independently determines its retail prices as described in Section 8.
Historical and promotional value statements
When TC Cache makes a factual historical statement such as a recent sale, highest observed sale, or comparable transaction, TC Cache should have a reasonable basis for the claim at the time it is made and may identify the source, date, condition, grade, or other relevant context where appropriate. Historical results do not guarantee that the same amount can be achieved again.
No financial or investment advice
TC Cache sells collectibles for collecting, enjoyment, gifting, play, display, and related lawful purposes. Information provided by TC Cache is not financial, investment, tax, legal, appraisal, or portfolio advice, and TC Cache does not guarantee that any collectible will maintain, increase, or recover value.
Customers are responsible for deciding whether a collectible is appropriate for their own purposes and should not purchase merchandise based on an assumption of guaranteed appreciation or profit.
Market movement after sale
Changes in market value after an accepted transaction are governed by Section 10. A later increase does not give TC Cache a right to cancel solely because the item became more valuable, and a later decrease does not by itself entitle the customer to a retroactive refund or price adjustment.
26. TC Cache Build Program
TC Cache may offer customer-directed product-building services under names such as Build a Booster, Build a Deck, Build a Set, Build a Box, Build a Bundle, or other future TC Cache “Build” offerings (collectively, the “Build Program”). Build Program products are independently configured and assembled by Trading Card Cache LLC according to customer selections and the options made available by TC Cache.
Independent TC Cache assembly
A Build Program product may contain genuine trading cards, collectibles, accessories, packaging, or other products originally produced by one or more third-party manufacturers, publishers, licensors, leagues, or brands. Unless TC Cache expressly states otherwise, the selection, grouping, presentation, packaging, and sealing of the completed Build product are performed by TC Cache and are not a manufacturer-created assortment.
The inclusion of genuine third-party products, names, trademarks, artwork, or other identifying material does not imply that the underlying manufacturer or rights holder sponsors, approves, or participates in the TC Cache Build Program. Third-party intellectual property remains the property of its respective owner.
Customer-directed selections
The customer is responsible for reviewing the Build configuration before submitting the order. Depending on the Build offering, the customer may select cards, quantities, finishes, categories, packaging artwork, themes, or other available options.
Unless TC Cache expressly states otherwise, a customer-created Build is not represented as:
- an official manufacturer booster, deck, box, set, bundle, or assortment;
- a tournament-legal or format-legal deck;
- a complete official manufacturer set;
- a manufacturer-recommended combination;
- a guaranteed-value assortment;
- a guaranteed grading candidate; or
- a product sponsored or approved by an underlying card company or rights holder.
Availability and Build validation
Build selections remain subject to authoritative inventory validation. If a selected card or component becomes unavailable before assembly because of an inventory discrepancy, prior sale, damage, or another legitimate issue, TC Cache may contact the customer to obtain an approved replacement, remove and refund the unavailable component where appropriate, or cancel the affected Build. TC Cache will not intentionally substitute a materially different customer-selected item without the customer's consent merely to complete a Build.
TC Cache may refuse or require modification of a requested Build configuration when reasonably necessary because the request is unlawful, infringes or appears to infringe third-party rights, contains prohibited or abusive material, creates a safety concern, cannot be fulfilled with available inventory, conflicts with published Build rules, or cannot reasonably be produced as requested.
Assembly, cancellation, and Final Sale treatment
Because Build Program products are assembled according to customer choices, a Build may become non-cancellable and Final Sale once custom assembly has begun, as disclosed before purchase and further described in the Returns & Refunds Policy. TC Cache will still provide an appropriate remedy where the completed Build materially differs from the customer's confirmed selections because of TC Cache's error, contains the wrong merchandise, is materially misdescribed, arrives with qualifying damage, or applicable law otherwise requires a remedy.
The fact that a Build product is customized does not permit TC Cache to disregard a confirmed customer selection or substitute materially different contents without authorization.
Unopened Build products and resale
Build Program products are intended for personal use, gifting, collecting, or opening. They are not intended for commercial resale as unopened TC Cache-assembled retail products.
As a condition of purchasing a Build Program product, the original purchaser agrees not to commercially advertise, distribute, or resell the completed TC Cache-assembled package in unopened or sealed form without TC Cache's prior written permission, to the extent such a contractual restriction is enforceable under applicable law.
Regardless of any contractual resale restriction, no person is authorized to:
- represent a TC Cache Build product as an official manufacturer-produced or manufacturer-sealed product;
- state or imply that an underlying card manufacturer, publisher, licensor, league, or rights holder assembled, sponsored, endorsed, approved, or distributed the TC Cache-created assortment;
- remove, conceal, alter, or falsify TC Cache source or independent-assembly disclosures for the purpose of misleading a buyer about the origin of the package; or
- otherwise materially misrepresent the source, contents, sponsorship, endorsement, or affiliation of the Build product.
Nothing in this section is intended to eliminate a right concerning lawfully owned physical property that applicable law makes non-waivable. Once the TC Cache-assembled package has been opened, the purchaser may ordinarily sell, trade, give away, or otherwise dispose of the individual lawfully owned cards or products, subject to applicable law and the rights of their respective owners.
The standalone Build Program Terms & Product Disclosure provides the more specific customer-facing Build rules and the current outside-package and inside-package disclosure wording.
Physical Build disclosures
TC Cache may place source, independent-assembly, non-affiliation, resale, or other disclosures on or inside Build Program packaging. Customers must not interpret packaging that uses TC Cache branding, original TC Cache artwork, or a TC Cache Build-series name as manufacturer packaging for the third-party cards contained inside.
Back to top27. Fully Loaded Promotional Thank-You Gifts
Fully Loaded is a limited TC Cache promotional thank-you gift program that may be offered in connection with merchandise specifically identified as Fully Loaded Eligible. Customers purchase the merchandise identified in their order at its displayed retail price. TC Cache does not separately sell Fully Loaded rolls, chances, entries, game play, or dice outcomes, and no separate charge is imposed solely for the Fully Loaded promotional process.
Merchandise pricing remains independent
TC Cache independently determines the retail price of its merchandise using ordinary retail considerations such as product condition, actual-item presentation, acquisition cost, supply, demand, inventory, rarity, market activity, comparable transactions, and other legitimate business factors. A third-party guide or marketplace price does not establish a mandatory selling price for TC Cache merchandise.
Fully Loaded eligibility does not create a separately stated fee for a promotional gift, and TC Cache will not represent a charge for a Fully Loaded roll or outcome as part of the merchandise price.
Qualifying merchandise and while-supplies-last availability
Only merchandise identified as Fully Loaded Eligible for the applicable transaction qualifies. A product does not remain permanently eligible merely because the same product, a similar product, or an earlier listing qualified at another time.
Fully Loaded is offered while promotional supplies last. TC Cache may activate, pause, suspend, modify, replace, or discontinue Fully Loaded eligibility for future transactions based on promotional inventory, operational capacity, program availability, legal requirements, or other legitimate business considerations.
TC Cache may remove Fully Loaded eligibility before a future purchase when gift inventory is depleted or the program is paused. TC Cache will not use a later change in program availability in bad faith to avoid an existing promotional obligation associated with an order that TC Cache already accepted as Fully Loaded Eligible.
Good-faith administration of accepted eligible transactions
If TC Cache accepts an order while the applicable merchandise is properly identified as Fully Loaded Eligible, TC Cache intends to administer the promotional process in good faith according to the Fully Loaded terms, board, eligibility rules, and consumer disclosure in effect for that transaction.
Fully Loaded promotional gifts are separate from the purchased merchandise and may vary in type and retail value according to the disclosed program process. Promotional gifts do not carry a guaranteed future market, grading, investment, or resale value.
Gift availability and substitution
Promotional gifts remain subject to actual availability. If a gift corresponding to an otherwise valid outcome becomes unavailable after an eligible transaction because of loss, damage, inventory discrepancy, discontinuation, or another circumstance outside TC Cache's reasonable control, TC Cache may, where permitted by applicable law and the applicable program terms, provide a substitute promotional gift of reasonably comparable or greater retail value.
The Fully Loaded consumer disclosure may identify available gifts, reasonable retail values, quantities, dice or outcome mechanics, reroll rules, material conditions, and other information applicable to the current program period or board.
Videos, photographs, and publication are optional
TC Cache may photograph, record, document, edit, retain, or publish Fully Loaded activity for transparency, entertainment, customer experience, recordkeeping, or marketing. TC Cache does not guarantee that any particular Fully Loaded activity will be individually recorded, edited, uploaded, published, retained online, or made publicly available.
The absence, removal, delay, editing, or non-publication of a video does not by itself invalidate an otherwise properly administered outcome. TC Cache may maintain simpler internal records of an outcome without producing public-facing media.
Returns, reversals, fraud, and abuse
Where permitted by the applicable program rules and law, a cancelled, refunded, reversed, fraudulent, or successfully charged-back qualifying transaction may lose associated Fully Loaded eligibility or benefits. TC Cache may also disqualify or restrict participation involving fraud, manipulated transactions, multiple-account abuse, attempts to interfere with the program process, or other material violations of the applicable rules.
No manufacturer affiliation
Fully Loaded is operated by Trading Card Cache LLC. Unless expressly stated otherwise, an underlying card manufacturer, publisher, licensor, grading company, marketplace, or other third party whose product appears in a Fully Loaded transaction or promotional gift does not sponsor, administer, endorse, or approve the Fully Loaded program.
Program-specific disclosures control
Fully Loaded may be subject to separate terms, consumer disclosures, jurisdictional limitations, promotional periods, and other requirements. If a specific Fully Loaded rule conflicts with this general section regarding operation of the program, the more specific rule controls for that subject, except that no program rule may eliminate a right that applicable law makes non-waivable.
Back to top28. Collector of the Month
TC Cache may operate a customer recognition, points, ranking, competition, or promotional program known as Collector of the Month. Participation is optional and is governed by the applicable Collector of the Month Official Rules, which control program-specific eligibility, scoring, ranking, tie handling, promotional periods, prizes, verification, and other conditions.
Eligibility and opt-in
Collector participation may require an eligible My Cache account, affirmative opt-in, checkout enrollment, or another method permitted by the Official Rules. Participation may be limited to persons who satisfy the age, residency, account, transaction, or other eligibility requirements stated in those Rules.
Choosing not to participate in Collector of the Month does not prevent an otherwise eligible customer from using ordinary TC Cache shopping or My Cache functions.
Collector nickname and public standings
Where the program includes a public leaderboard, TC Cache may display a participant's approved Collector nickname, points, rank, or other program information described in the Official Rules. TC Cache does not intend to publicly display a participant's private email address, shipping address, payment information, or legal name merely because the participant joins the program.
Points and ranking
Collector points, ranking, status, or similar program measures are promotional features. Unless TC Cache expressly states otherwise, they do not constitute cash, stored value, a bank account, transferable property, or a guaranteed right to a prize.
Cancelled, refunded, reversed, fraudulent, or charged-back transactions may have associated points or ranking effects removed or adjusted according to the Official Rules. TC Cache may also correct scoring errors, duplicate transactions, technical errors, or other inaccuracies in good faith.
Prizes and verification
A displayed ranking does not by itself create an unconditional right to a prize. Potential winners may remain subject to eligibility verification, compliance with the Official Rules, tie procedures, account review, and other lawful conditions stated in the program rules.
Winners are responsible for federal, state, local, or other taxes associated with a prize to the extent applicable. TC Cache may request information reasonably necessary to satisfy tax-reporting or other legal obligations and may issue tax documentation where required by law.
Future changes
TC Cache may modify, pause, replace, or discontinue Collector of the Month for future program periods, subject to the Official Rules, applicable law, and any obligations already created for a completed or ongoing period. Material changes should not be applied retroactively in bad faith to deprive a verified participant of a benefit already earned under controlling rules.

Marketing enrollment is optional and is separate from acceptance of these Terms, creation of a My Cache account, ordinary purchase eligibility, and enrollment in other optional TC Cache programs unless a specific promotion lawfully states otherwise.
Optional consent
If you affirmatively opt in to receive TC Cache marketing, TC Cache may send communications about products, restocks, promotions, sales, programs, special offers, events, or other TC Cache news through the channels covered by your consent.
TC Cache will not treat acceptance of the Terms and Conditions or Privacy Policy as consent to receive optional marketing where separate consent is required.
Unsubscribing
You may withdraw consent to receive marketing messages through the unsubscribe method provided in the communication, through available My Cache preferences, or through another method TC Cache makes available. TC Cache will process valid opt-out requests as required by applicable law.
Transactional and security communications
Marketing opt-out does not prevent TC Cache from sending non-marketing communications reasonably necessary to operate your account or transaction, including:
- verification or account-security codes;
- password or security notices;
- order confirmations and receipts;
- shipping and tracking notices;
- refund, cancellation, or return communications;
- material account or policy notices; or
- other legally required or service-related communications.
Transactional or security messages should not be used as a pretext to disguise unrelated promotional advertising where applicable law prohibits that practice.
Back to top30. Privacy, Cookies, and Browser Storage
TC Cache's collection, use, disclosure, retention, and protection of personal information are governed in greater detail by the TC Cache Privacy Policy. That policy is incorporated into these Terms where applicable but is intended to remain a separate document so privacy disclosures can be updated as technology, law, and business practices evolve.
Account and transaction information
TC Cache may process information reasonably necessary to operate My Cache accounts and fulfill transactions, including account information, order history, shipping information, authentication records, security records, program participation, transaction identifiers, and other information described in the Privacy Policy.
TC Cache does not intend to store complete payment-card numbers, card security codes, or third-party payment passwords when those credentials are handled directly by an independent payment processor.
Essential first-party cookies
TC Cache may use first-party cookies for functions such as:
- maintaining authenticated My Cache sessions;
- recognizing a browser that a customer elected to trust for a limited period;
- temporary verification or account-recovery grants;
- shopping-cart continuity;
- site or Shop preferences;
- security and fraud prevention; and
- other functionality reasonably necessary to provide Services requested by the user.
Disabling essential cookies may prevent some account, cart, checkout, or security features from working correctly.
Local storage and similar browser technologies
TC Cache may use local storage, session storage, or similar first-party browser technologies for information that is better suited to local persistence than a cookie, including an in-progress Build Program configuration, cart state, interface preferences, or other non-sensitive functional data described in the Privacy Policy.
Browser storage is a convenience and is not the authoritative legal record of a customer's Terms acceptance, account status, order, inventory entitlement, or other server-controlled right.
Legal acceptance records
TC Cache may maintain server-side records showing the legal document version presented, acceptance timestamp, account or order identifier, and acceptance context. Deleting browser cookies or local storage does not erase a legal acceptance or transaction record that TC Cache is lawfully permitted or required to retain.
Third-party services and embedded content
Some TC Cache pages may use third-party services or embedded content, such as payment services, shipping services, email infrastructure, fraud-prevention systems, or embedded social-media content. Those third parties may process technical or transaction information under their own terms and privacy practices as described in the Privacy Policy.
Advertising and cross-site tracking
As of the planned Version 1.0 launch, TC Cache does not intend to sell customer personal information for money or use third-party advertising cookies for cross-site behavioral advertising. If TC Cache later introduces advertising pixels, remarketing, cross-context behavioral advertising, or similar technology, the Privacy Policy and any legally required notices, choices, or consent mechanisms should be updated before or when that functionality is introduced.
Security
TC Cache uses reasonable technical and organizational measures intended to protect customer and account information, but no website, database, transmission method, browser storage system, or security control can guarantee absolute security. Customers are responsible for taking reasonable precautions to protect their own email accounts, devices, Vault Passwords, and verification codes.
Back to top31. Prohibited Conduct
You may use TC Cache only for lawful purposes and in a manner consistent with these Terms, applicable program rules, and the ordinary intended operation of the Services. TC Cache may investigate and respond to conduct that reasonably threatens customers, the business, third parties, or the integrity of the Services.
Fraud, deception, and abuse
You may not use the Services to engage in or facilitate conduct such as:
- payment fraud, use of stolen or unauthorized payment information, identity fraud, or knowingly false chargeback claims;
- return substitution, resealing, product swapping, false nonreceipt claims, fabricated damage claims, or other return or fulfillment fraud;
- impersonation, materially false account information, or deceptive conduct intended to obtain merchandise, benefits, refunds, promotional gifts, points, or account access;
- manipulation of purchase limits, Collector standings, Fully Loaded eligibility, discounts, promotional benefits, or other program rules;
- knowingly exploiting a material pricing, inventory, catalog, checkout, authentication, or software error for an improper benefit after the error is apparent;
- selling, transferring, or using a My Cache account in violation of Section 3; or
- using the Services in connection with conduct that violates applicable law or another person's rights.
Security and system integrity
You may not, without TC Cache's authorization:
- attempt to gain access to another person's account, private records, administrative functions, credentials, sessions, tokens, databases, or non-public systems;
- introduce malware, malicious code, credential-stealing software, denial-of-service traffic, or other harmful technology;
- bypass or defeat authentication, rate limits, waiting rooms, purchase limits, access controls, bot protections, or other security measures;
- probe, scan, test, or exploit TC Cache systems in a manner that is unauthorized, destructive, materially disruptive, or designed to obtain non-public information; or
- interfere with another customer's ability to access or use the Services.
Nothing in this section is intended to prohibit ordinary browser functions, password managers, assistive technology, accessibility tools, security software, or good-faith use of a publicly documented TC Cache interface according to its stated rules.
Personal information and communications
You may not harvest, compile, sell, publish, or misuse private customer information obtained through unauthorized access to the Services. You also may not use TC Cache support, forms, reviews, nicknames, or other communication features to transmit unlawful threats, malicious links, spam, or content intended to facilitate fraud or compromise another person's security.
Proportionate enforcement
TC Cache may take proportionate action in response to prohibited conduct, including cancelling an affected transaction where legally permitted, removing promotional eligibility, correcting improperly obtained points or benefits, restricting features, suspending or closing accounts, preserving relevant records, or referring credible unlawful conduct to a payment provider, carrier, platform, insurer, or appropriate authority.
This section does not convert a legitimate customer complaint, good-faith payment dispute, honest review, return request, accessibility use, or reasonable security report into prohibited conduct merely because TC Cache disagrees with it.
Back to top32. Bots, Automation, and Traffic Abuse
Automated activity can affect limited collectible inventory, purchase fairness, account security, website availability, and the ability of other customers to use TC Cache. TC Cache may therefore restrict or manage automated access to the Services.
Prohibited automation
Unless TC Cache expressly authorizes the activity, you may not use a bot, script, crawler, scraper, headless browser, automated purchasing tool, credential-testing tool, or similar system to:
- purchase or attempt to purchase merchandise in a manner designed to defeat quantity limits, waiting rooms, human-verification controls, or other fair-access restrictions;
- create or control multiple accounts, submit repeated promotional entries, manipulate Collector standings, or obtain benefits in violation of applicable rules;
- generate excessive requests, repeated searches, checkout attempts, login attempts, or other traffic that materially degrades or threatens the Services;
- circumvent a technical restriction, access non-public endpoints, or collect non-public customer or business information;
- automatically copy substantial portions of TC Cache's original site content, photographs, product database, or proprietary presentation for republication or a competing commercial service where such copying is not otherwise permitted by law; or
- conduct credential stuffing, card testing, vulnerability exploitation, denial-of-service activity, or other malicious automation.
Permitted and ordinary technology
This section does not prohibit ordinary use of assistive technologies, accessibility tools, password managers, browser autofill, search-engine indexing that TC Cache permits, security tools operating on the user's own device, or other normal browser functions that do not defeat TC Cache controls or materially interfere with the Services.
TC Cache may also provide APIs, feeds, structured data, or written permission for particular automated uses. Any such authorization is limited to the scope and conditions stated by TC Cache and may be modified or revoked for future access.
Traffic controls
TC Cache may use rate limiting, request throttling, temporary blocks, CAPTCHA or Turnstile challenges, queueing, waiting rooms, session controls, cache controls, bot-detection systems, or other reasonable technical measures to protect availability and fair access. A temporary technical restriction does not create a right to circumvent the restriction through alternate accounts, addresses, networks, devices, or tools.
TC Cache may cancel transactions obtained through prohibited automation where legally permitted, particularly where automation defeated a published purchase limit, security control, or program rule. TC Cache will not treat ordinary accessibility technology as prohibited automation merely because it performs automated functions.
Back to top33. Product Recalls and Safety
TC Cache may sell toys, collectibles, accessories, building products, games, or other consumer products in addition to trading cards. Product-safety laws and manufacturer recall programs may therefore apply to some merchandise.
Recalled or unsafe merchandise
TC Cache will not knowingly offer a consumer product for sale when sale is prohibited because the product is subject to an applicable safety recall, corrective action, ban, or other legal restriction. If TC Cache learns that merchandise in inventory may be recalled, unlawfully noncompliant, or associated with a credible safety issue, TC Cache may immediately deactivate the listing, stop fulfillment, quarantine inventory, investigate the issue, or take other appropriate action.
Orders affected before shipment
If an unfulfilled order contains merchandise that becomes subject to an applicable recall, safety prohibition, or other legal restriction before shipment, TC Cache may cancel the affected merchandise rather than ship it. Any amount paid for cancelled merchandise will be refunded as required by law.
Previously delivered products
If TC Cache learns that previously sold merchandise is affected by a recall or safety corrective action, TC Cache may use available order records to contact affected customers where appropriate, provide manufacturer or government recall information, and assist with the stated recall process. The manufacturer, importer, government agency, or other responsible party may control the repair, replacement, refund, disposal, or other remedy specified by the recall.
Customers should follow safety instructions contained in an applicable recall notice, including instructions to stop using a product where directed. A product should not be resold merely because it appears undamaged if applicable law prohibits its sale because of a recall.
No waiver of safety rights
Nothing in these Terms limits a product-safety remedy, reporting obligation, recall right, or other protection that applicable law does not permit the parties to waive.
34. TC Cache Intellectual Property
The TC Cache website and Services contain original and licensed materials protected by copyright, trademark, trade-dress, unfair-competition, contract, and other applicable laws. Except for third-party materials identified below, rights in original TC Cache content are owned by or licensed to Trading Card Cache LLC.
TC Cache materials
Protected TC Cache materials may include, as applicable:
- the TC Cache name, logos, emblems, slogans, and original brand presentation;
- the Jaimus character and original Jaimus artwork;
- original photographs, illustrations, graphics, packaging artwork, written copy, videos, and promotional materials;
- original Build Program presentation, packaging concepts, series names, interfaces, and TC Cache-created design elements;
- website layouts, source code, scripts, databases, compilations, interfaces, and original software components; and
- other original materials created for or lawfully licensed to TC Cache.
Limited permission to use the Services
Subject to these Terms, TC Cache grants you a limited, personal, non-exclusive, non-transferable, and revocable permission to access and use the public-facing Services for ordinary shopping, account use, participation in permitted programs, customer support, and other intended purposes.
That permission does not grant ownership of TC Cache intellectual property or a right to reproduce, sell, license, commercially exploit, create misleading derivative branding from, or republish substantial original TC Cache content except with permission or where applicable law independently permits the activity.
Third-party brands and products
Pokémon, Magic: The Gathering, Disney, Lorcana, sports leagues, manufacturers, publishers, grading companies, and other third-party names, characters, artwork, logos, product designs, and trademarks remain the property of their respective owners. TC Cache's sale, identification, photography, discussion, or lawful use of genuine third-party products does not mean that those rights holders sponsor, endorse, approve, or operate TC Cache unless TC Cache expressly states that an actual relationship exists.
TC Cache claims no ownership merely because third-party intellectual property appears on genuine merchandise, manufacturer packaging, reference images, or other lawful product-identifying material.
No false affiliation
You may not use TC Cache names, logos, branding, Build packaging, or other source-identifying material in a way that falsely states or materially implies that you are TC Cache, an authorized TC Cache seller, a TC Cache employee, or otherwise officially sponsored or endorsed by Trading Card Cache LLC.
Lawful references and protected rights
Nothing in these Terms is intended to prohibit lawful criticism, commentary, news reporting, comparison, nominative use, fair use, resale of lawfully owned individual merchandise, or another use that applicable law permits without TC Cache's authorization.
If you believe content on TC Cache infringes intellectual property that you own or are authorized to represent, you may contact TC Cache through the support method published on the site with sufficient information to identify the material and the basis for your concern.
Back to top35. Third-Party Services and Links
TC Cache relies on independent third parties to provide parts of the ecommerce, payment, shipping, communication, security, content, and data infrastructure used by the Services. Examples may include payment processors such as PayPal, carriers such as USPS, postage or shipping providers such as Pitney Bowes, infrastructure providers such as Cloudflare, email providers such as Resend, social-media services such as TikTok, grading companies, manufacturers, market-data providers, and other vendors.
Independent services
A third party may impose its own terms, privacy practices, eligibility requirements, service limitations, or technical rules when you interact directly with that service. TC Cache does not control the independent policies or systems of those third parties and does not guarantee that a particular third-party service will remain available indefinitely.
Payments, carriers, and other providers
Use of a payment processor, carrier, grading company, social-media platform, or other provider does not make that provider an employee, agent, joint venturer, or partner of TC Cache merely because the service is integrated with or referenced by the site. Likewise, TC Cache is not automatically responsible for every independent act, outage, policy decision, carrier scan, platform restriction, or grading determination made by a third party.
This allocation of responsibility does not excuse TC Cache from obligations that applicable law imposes on TC Cache itself, including obligations concerning accepted orders, refunds, consumer disclosures, product safety, privacy, or other non-waivable responsibilities.
External links and embedded content
TC Cache may link to or embed third-party websites, media, tracking pages, product information, or other external content for convenience or informational purposes. Unless TC Cache expressly states otherwise, a link or embed does not constitute endorsement of all content, products, claims, security practices, or privacy practices of the external service.
Third-party websites can change without notice. Customers should use reasonable care before submitting credentials, payment information, or personal information to an external site.
Third-party interruptions
If a third-party outage or failure materially affects checkout, payment authorization, email delivery, shipping-label generation, tracking, or another Service, TC Cache may delay the affected operation, use an available alternative provider, contact the customer, or take another reasonable step necessary to complete or unwind the transaction. Applicable customer cancellation, refund, and shipping rights remain unaffected.
Back to top36. Website Availability and Cached Data
TC Cache works to keep the Services available, accurate, and responsive, but an online storefront cannot be guaranteed to operate without interruption, delay, maintenance, or error. The Services may occasionally be unavailable, limited, or degraded because of maintenance, software changes, traffic levels, security controls, network conditions, third-party outages, or other operational circumstances.
Maintenance, outages, and degraded operation
TC Cache may temporarily suspend or limit a feature when reasonably necessary to maintain, update, repair, secure, or protect the Services. Where practical, TC Cache may provide notice of planned maintenance, but emergency maintenance or security action may occur without advance notice.
An interruption or technical failure does not by itself create a right to merchandise, a particular price, a promotional benefit, compensation, or damages that would not otherwise exist under the applicable transaction, policy, or law.
Cached and delayed public information
To improve speed, reliability, and resilience, TC Cache may use browser caching, content-delivery-network caching, edge caching, or last-known-good copies of public information. As a result, public pages may briefly display information that is slightly older than the authoritative server-side record.
Cached or delayed information may include product availability, public site content, Featured items, leaderboard information, program information, or other non-payment data. A cached display does not override authoritative inventory, account, order, payment, or security records.
Inventory and checkout validation
Inventory shown on a public page may change before checkout is completed, particularly for one-of-one or low-quantity collectibles. TC Cache may revalidate inventory, price, product status, purchase limits, and other transaction requirements during checkout or order processing.
If stale public data conflicts with the authoritative transaction record, TC Cache will use the authoritative record and handle any affected order according to the provisions governing inventory, pricing errors, cancellation, refunds, and applicable law.
Service changes and fallback operation
TC Cache may change the technical implementation, hosting provider, caching strategy, interface, or other operational components of the Services without changing a customer's already accepted transaction rights. During a temporary backend or third-party outage, TC Cache may display a limited, cached, or read-only version of some public content rather than making the entire storefront unavailable.
No waiver of mandatory rights
Nothing in this section excuses TC Cache from an obligation to correct an accepted transaction, provide a required refund, protect personal information, honor a non-waivable warranty, or comply with another duty imposed by applicable law.

Different rules can apply to the TC Cache website and online Services than to physical consumer goods. This section is intended to address those categories separately rather than using a blanket product warranty disclaimer.
Website and online Services
To the maximum extent permitted by applicable law, the website, account interfaces, public informational features, and other online Services are provided on an “as available” basis. TC Cache does not promise that every online feature will be uninterrupted, permanently available, error-free, compatible with every browser or device, or immune from third-party outages or malicious activity.
TC Cache does not guarantee that public market data, third-party catalog information, carrier tracking, leaderboard displays, embedded media, or similar externally sourced or rapidly changing information will always be complete, current, or error-free. Transaction-specific representations expressly made by TC Cache remain subject to the applicable listing and order terms.
Physical merchandise and express descriptions
Nothing in these Terms is intended to erase an express factual representation, product description, or warranty that applicable law treats as part of the bargain. Merchandise is expected to conform materially to the accepted listing and any express promise that legally applies to the transaction.
TC Cache does not use this section as a blanket disclaimer of the implied warranty of merchantability, the implied warranty of fitness for a particular purpose, or another consumer warranty where applicable law makes such a disclaimer ineffective, requires additional formalities, or otherwise preserves the warranty.
Manufacturer warranties
Some merchandise may carry a warranty, guarantee, replacement program, or support obligation offered by the manufacturer or another third party. Any such third-party warranty is governed by the warrantor's terms and may vary by product, region, purchase channel, or eligibility. TC Cache does not independently expand a manufacturer's warranty merely by reselling the product.
Where applicable law imposes responsibilities on TC Cache as the seller, the existence of a manufacturer warranty does not eliminate those responsibilities.
Collectibles and ordinary characteristics
Collectible merchandise is subject to the condition, factory-variation, grading, sealed-product, imported-product, and randomized-product provisions of these Terms. The absence of a guaranteed grade, future market value, particular pull, cosmetically perfect outer package, or third-party grading outcome is not itself a product defect when no such guarantee was made.
No investment, grading, or compatibility warranty unless stated
Unless TC Cache expressly makes a specific written promise in the applicable listing, TC Cache does not warrant future collectible value, investment performance, third-party grading results, tournament legality, digital-code compatibility, or compatibility with a particular third-party platform, device, region, or service.
38. Limitation of Liability
This section allocates certain risks associated with the Services and transactions. It applies only to the maximum extent permitted by applicable law and does not eliminate liability or remedies that the law does not permit TC Cache to limit.
Excluded categories of damages
To the maximum extent permitted by law, TC Cache will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages that are not the direct and legally recoverable result of TC Cache's breach or wrongful conduct. This includes, where legally permitted, claimed losses based on:
- anticipated collectible appreciation or missed resale opportunity;
- speculative trading, investment, grading, or market profit;
- loss of an expected pull, grade, ranking, promotional opportunity, or future program benefit that was never guaranteed;
- loss caused solely by a third party's independent platform, carrier, grading, market-data, or service decision where TC Cache is not legally responsible for that conduct; or
- business interruption or lost profits arising from personal consumer use of the Services where such damages were not reasonably contemplated and recoverable under applicable law.
Transaction-related liability cap
To the maximum extent permitted by applicable law, TC Cache's aggregate monetary liability for a claim arising directly from a particular purchase will not exceed the amount actually paid to TC Cache for the product or transaction giving rise to that claim, except where a greater remedy is required by law or where this limitation would cause a legally protected remedy to fail of its essential purpose.
Non-purchase Services
For a claim arising solely from use of a non-purchase Service and not from physical injury, property damage, a privacy or security obligation, or another non-waivable right, TC Cache's aggregate monetary liability will, to the maximum extent permitted by law, be limited to the greater of $100 or the amount the claimant paid directly to TC Cache for the specific non-purchase Service giving rise to the claim during the twelve months preceding the event.
What is not limited
Nothing in these Terms limits or excludes liability to the extent applicable law prohibits limitation, including as applicable liability for fraud, intentional misconduct, personal injury, product liability, legally protected warranty claims, certain grossly negligent conduct, required privacy or data-security remedies, or statutory consumer remedies that cannot be waived.
Some jurisdictions do not allow particular exclusions or limitations of damages. In those jurisdictions, this section applies only to the extent the applicable exclusion or limitation is lawful.
No duplicate recovery
Nothing in these Terms entitles either party to recover the same loss more than once under multiple legal theories. Any limitation applies to the claim as a whole rather than multiplying solely because a claimant characterizes the same alleged loss under several causes of action, to the extent permitted by law.
Back to top39. Indemnification
To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless Trading Card Cache LLC and its members, managers, officers, employees, contractors, and authorized agents from reasonable third-party claims, liabilities, losses, damages, judgments, and costs, including reasonable attorneys' fees where recoverable, to the extent arising from your own:
- intentional fraud or material misrepresentation;
- unauthorized or unlawful use of another person's payment method, account, identity, personal information, or intellectual property;
- content, artwork, wording, nickname, customization request, or other material you submit to TC Cache that infringes or unlawfully violates a third party's rights;
- commercial resale, repackaging, relabeling, or representation of a TC Cache Build product in a manner that materially misrepresents its source, manufacturer affiliation, sponsorship, or endorsement;
- malicious interference with the Services, unauthorized access, distribution of malware, or prohibited automated activity; or
- other intentional unlawful conduct or deliberate material violation of these Terms that directly causes a third-party claim against TC Cache.
Scope and fairness
This indemnification obligation is intended to address third-party claims caused by the customer's own wrongful conduct. It does not require a customer to indemnify TC Cache for TC Cache's own fraud, intentional misconduct, negligence, unlawful conduct, product defect, breach, or other responsibility to the extent applicable law places that responsibility on TC Cache.
Ordinary use of the Services, an honest negative review, a good-faith customer complaint, a legitimate payment dispute, or lawful exercise of consumer rights does not by itself create an indemnification obligation.
Notice and cooperation
If TC Cache seeks indemnification for a covered third-party claim, TC Cache will provide reasonable notice when practicable and may request reasonable cooperation in defending the claim. TC Cache may control the defense of a covered claim using reasonably selected counsel, but TC Cache will not agree to a settlement that requires the customer to admit wrongdoing or undertake a material non-monetary obligation personally without the customer's consent, unless a court or applicable law independently requires that result.
Back to top40. Force Majeure
TC Cache is not responsible for a reasonable delay or inability to perform an obligation to the extent the delay is caused by an event beyond TC Cache's reasonable control and is not the result of TC Cache's bad faith or a failure to take reasonable measures that applicable law requires.
Examples of events beyond reasonable control
Depending on the circumstances, such events may include:
- severe weather, fire, flood, earthquake, natural disaster, or other emergency;
- epidemic, pandemic, public-health order, or government restriction;
- war, terrorism, civil unrest, embargo, sanctions, or government action;
- carrier, postal, transportation, utility, power, telecommunications, or widespread internet disruption;
- material outage or failure of a payment, cloud, hosting, security, email, or other critical third-party provider;
- cyberattack or other malicious event despite reasonable security measures;
- manufacturer, distributor, or supplier interruption, allocation, recall, or unexpected unavailability;
- labor interruption or other event that materially prevents normal fulfillment; or
- another comparable circumstance outside TC Cache's reasonable control.
Effect on affected transactions
TC Cache may reasonably delay, suspend, substitute an available service provider, or cancel the affected unfulfilled portion of a transaction when necessary because of a force-majeure event. If TC Cache cancels paid merchandise that will not be fulfilled, TC Cache will provide the refund required by the applicable transaction terms and law.
Where practical, TC Cache will use reasonable efforts to mitigate the disruption and communicate material delays affecting accepted orders.
Consumer and shipping rights remain
A force-majeure event does not eliminate a customer's mandatory cancellation, shipping-delay, refund, warranty, product-safety, privacy, or other non-waivable rights. TC Cache will not invoke force majeure merely because a product increased in market value after a valid sale or because fulfilling an accepted transaction later became less profitable.
Customer obligations already completed
Force majeure does not ordinarily require TC Cache to refund merchandise already properly delivered and retained merely because an unrelated later event affects the Services. Any return, refund, recall, or warranty right continues to be determined under the applicable policy and law.
Back to top41. Disputes and Informal Resolution
TC Cache wants reasonable customer concerns addressed before they become formal disputes. Except where a shorter or different procedure is required by applicable law, the parties should make a good-faith effort to resolve a dispute directly before beginning ordinary civil litigation.
Notice of dispute
Before filing an ordinary civil action against TC Cache, and to the extent legally permitted, you agree to send TC Cache a written notice describing the dispute and allow up to 30 days for a good-faith attempt at resolution. TC Cache will provide the same opportunity when reasonably practicable before bringing an ordinary civil claim against a customer.
A notice should include enough information to identify and evaluate the matter, such as:
- your name and a reliable method of contact;
- the relevant order number, account email, or transaction identifier, if applicable;
- a concise description of what occurred;
- the specific relief or resolution requested; and
- supporting information reasonably necessary to understand the dispute.
Do not include your Vault Password, one-time verification code, complete payment-card number, card security code, or other security credential in a dispute notice.
Exceptions
The informal-resolution period does not prevent either party from:
- bringing an eligible claim in small claims court;
- seeking emergency, temporary, or injunctive relief where delay could cause material harm;
- responding to a lawsuit, subpoena, government inquiry, payment dispute, or legal deadline;
- making a legally protected report to a regulator, law-enforcement agency, payment provider, or consumer-protection authority; or
- exercising another right that applicable law does not permit these Terms to delay or restrict.
Deadlines are not automatically extended
The informal-resolution process does not by itself extend, shorten, waive, or toll a statute of limitations, filing deadline, chargeback deadline, or other legal time period unless applicable law provides otherwise or the parties expressly agree in writing.
No mandatory arbitration in Version 1.0
These Version 1.0 Terms do not require mandatory arbitration and do not contain a contractual class-action waiver. Any future decision to adopt an arbitration provision would require separate legal review, prospective terms, and any notice or renewed assent required by applicable law.
Back to top42. Governing Law
Except to the extent a different law must apply, these Terms and disputes arising from the Services or transactions with Trading Card Cache LLC are governed by the laws of the State of New Hampshire, without applying choice-of-law rules solely to select another jurisdiction's law.
Mandatory consumer rights remain
This governing-law provision is not intended to deprive a consumer of a protection that federal law or the law of the consumer's state of residence makes non-waivable. If applicable law requires a particular consumer-protection, privacy, warranty, refund, shipping, or other rule to apply despite the New Hampshire governing-law provision, that mandatory rule controls to the extent required.
Different rules for particular transactions
A product-specific notice, Official Rules, recall, manufacturer warranty, payment-provider requirement, or other legally applicable rule may govern a particular issue without replacing these Terms for unrelated issues. International or future services may also be subject to additional terms if TC Cache expressly introduces them.
Back to top43. Venue and Court Proceedings
To the fullest extent permitted by applicable law, an ordinary court proceeding arising from these Terms or the Services should be brought in an appropriate state court located in Rockingham County, New Hampshire, or, where federal jurisdiction exists, in the United States District Court for the District of New Hampshire.
Consumer and jurisdictional exceptions
This venue provision does not require a consumer to surrender a forum, small-claims right, jurisdictional protection, or venue right that applicable law makes non-waivable. If a court determines that another forum must be available for a particular claim, the remainder of this venue provision remains effective to the extent lawful.
Small claims
Either party may bring an eligible individual dispute in a small claims court that has lawful jurisdiction over the claim, even if that court is outside the preferred New Hampshire venue stated above.
No waiver by defending elsewhere
If TC Cache responds to a proceeding filed in another jurisdiction, that response does not necessarily constitute a general waiver of an available jurisdictional, service, forum, or venue objection.
Back to top44. Changes, Versioning, and Service Changes
TC Cache may update these Terms as the business, Services, technology, programs, or applicable law evolve. TC Cache uses versioning so customers and TC Cache can identify which Terms applied to a particular account acceptance or transaction.
Version information
Each published version of these Terms should identify a version number, effective date, and last-updated date. TC Cache may retain historical versions for legal, operational, audit, and customer-reference purposes.
Material changes
When TC Cache makes a material change that reasonably requires renewed assent, TC Cache may require an account holder to review and accept the updated Terms before continuing to use affected My Cache features. Notice may also be provided through the website, My Cache, email, or another reasonable method where appropriate.
Minor clarifications, formatting changes, corrections that do not materially change customer rights or obligations, or updates required merely to reflect current contact or operational information may not require a new acceptance unless applicable law requires one.
No silent retroactive rewriting of completed sales
Unless applicable law requires otherwise or the customer expressly agrees, TC Cache will not use a later version of these Terms to retroactively change the material economic terms of an already accepted purchase. An order is generally governed by the Terms and transaction-specific policies presented or incorporated when the order was placed and accepted.
Program and policy versions
Separate policies and program rules, including Fully Loaded disclosures, Collector Official Rules, Shipping Policy, Returns & Refunds Policy, Privacy Policy, and Build disclosures, may use their own version numbers and effective dates. Updating one document does not automatically change the version of every other document.
Changes to Services
TC Cache may add, remove, redesign, replace, suspend, or discontinue website features, programs, account functions, payment methods, carriers, product categories, or other Services for future use. A discontinued feature does not create a permanent entitlement to continued access, but TC Cache will not use a Service change in bad faith to avoid an existing legal obligation, accepted order, earned refund, or other right that already vested under applicable terms.
Back to top45. Electronic Records and Communications
TC Cache operates primarily online. By using the Services to create an account, submit an order, accept legal terms, or communicate about a transaction, you agree to conduct those interactions electronically to the extent permitted by applicable law.
Electronic contracts and signatures
Electronic records, electronic signatures, checkbox acceptance, and other electronic manifestations of assent may have legal effect where permitted by law. TC Cache may use server-side records to document the version presented, acceptance context, date and time, account or order identifier, and related transaction information.
New Hampshire's Uniform Electronic Transactions Act recognizes that a contract, record, or signature generally may not be denied legal effect solely because it is electronic. Nothing in these Terms is intended to override a law that requires a different form of consent, notice, delivery, or record for a particular matter.
Retention and reproducibility
TC Cache may retain electronic records in a form intended to accurately reflect the information and remain accessible for later reference. Records may include:
- account and legal acceptance history;
- order confirmations and transaction events;
- payment and refund identifiers;
- shipping and tracking information;
- program participation and eligibility records;
- customer-service and dispute communications; and
- security, fraud-prevention, and account-action records.
Electronic records may be used as business records or evidence to the extent permitted by applicable law, but a server record does not prevent a customer or TC Cache from presenting reliable evidence that a record is inaccurate.
Electronic notices
TC Cache may provide ordinary account, order, policy, or Service communications electronically through the website, My Cache, or email where legally permitted. You are responsible for maintaining a current email address associated with your account or order when email delivery is necessary.
If applicable law requires special consent, paper delivery, a particular disclosure, or another procedure before a legally required notice may be delivered electronically, TC Cache will follow that requirement rather than relying solely on this general section.
Automated security email
Automated account and verification messages may be sent from confirmation@tccache.com. That mailbox may be system-generated and not monitored for replies. TC Cache will never ask you to reply by email with your Vault Password, verification code, or complete financial credentials, and TC Cache does not send password-reset links by email.

Security warning
Do not send your Vault Password, one-time verification code, complete payment-card number, card security code, or third-party payment password to TC Cache by email. TC Cache will never request those credentials through an unsolicited email reply.
